Image Use Policy
Aims of policy
· Parents must refrain from using mobile devices at any time while in the setting. Mobile devices are not to be used in the setting to photograph or video any child at any time.
· All images and videos taken within and by Carmel Caterpillars Pre-school are taken and held legally and thought is always given to safeguarding all members of Carmel Caterpillars Pre-school.
· This policy applies to all staff, children, parents/Carers, the committee, visitors, volunteers and other individuals who work or provide services on behalf of Carmel Caterpillars Pre-school.
· This policy must be read in conjunction with other relevant Pre-school policies.
· This policy applies to all images, including still and video content, taken by the Pre-school.
· All images taken by the Pre-school will be used in a manner respectful of the 8 Data Protection Principles. (Data Protection Act 1998)
· The Designated Safeguarding Leader (DSL) or Manager is responsible for ensuring the acceptable, safe use and storage of all camera technology and images within the Pre-school.
Parental Consent
· Written consent is obtained prior to your child starting Pre-school for any images/videos taken to be used on our Website/Facebook group page, newspaper advertising, Pre-school journals and general displays throughout the setting.
· A record of all consent details will be kept securely on file. Should permission be withdrawn by parents/carers at any time, then all relevant images will be removed and disposed of and the records be updated accordingly.
Safety of images and videos
· All images are taken on authorised devises and will be kept for no longer than is necessary. At all times Data Protection and safeguarding requirements will be adhered to.
· The DSL reserves the right to review any images and/or to withdraw or modify a member of staff’s authorisation to take or make images at any time.
· Carmel Caterpillars Website and Facebook group have risk assessment strategies in place relating to the use of children’s images. We will ensure that no child’s image will appear in any newspaper article without the parent’s prior consent. No children’s name or any other personal information will be published on the Website, Facebook group or in any newspaper articles.
· Carmel Caterpillars Pre-school will ensure that images are always held in accordance with the Data Protection Act 1998 and suitable child safeguarding requirements are in place.
· Images of the children no longer required will be returned to parent/carer, deleted or shredded as appropriate.
Sharing images of children on Facebook and Website
· Carmel Caterpillars Pre-school upload and share images of children with parents on our Website and Facebook group. These images will only be taken on authorised devices.
· The use of these sites has been appropriately risk assessed and the DSL/Manager has taken steps to ensure that all data requirements for safeguarding and Data Protection.
Safe practice when taking images and videos
· Careful consideration is given when involving very young or vulnerable children when taking photos or recordings.
· Photography will not be permitted in any sensitive areas such as the toilets.
Use of photos/videos by parents/carers
· Parents are unable to use mobile devices to photograph or video their child at any time. However, the use of video cameras and regular cameras are permitted within the setting to take photos of your child only. Any photos that contain images of anyone other than your own child MUST NOT BE UPLOADED TO ANY WEBSITES OR SOCIAL NETWORKING SITES
· Parents may contact the Pre-school DSL/Manager to discuss any concerns regarding the use of images.
Use of images by media
· Only photographers from the media will be allowed in to Carmel Caterpillars Pre-school by prior agreement from a member of staff from the Pre-school.
· Only images of children who have been given prior written consent from Parents/carers will be published.
· Only first names will be published alongside the images used by the media.
Use of professional photographers
· Any photographers who are engaged to record any events will work in accordance with the terms of the settings E-safety policy and ensure compliance with the Data Protection Act 1998.
· Images will only be used for specific purpose as set down by the Pre-school and subject to parental consent.
· Photographers will at no time have unsupervised access to the children.
